hello busybee,

did the visa officer return to you the supporting documents you gave to him/her at that time...i mean if he/she gave to you the supporting documents like letters, emails, etc...then you are approve if not...they need to look again your file......also if he /she gave back the suppoting documents and said we will have a criminal check maybe you are approved....i hope you are...please tell us here in asawa if you are approve so we can take part the joy you have...hehehehe....

Hi Rose,
No, the officer kept the supporting documents and also took the recent ones. She said that IF she is satisfied with the new supporting documents AND the interview, she will thendo a criminal check and then IF the criminal check comes back ok, my wife will be approved. If not, she will be denied.

That's a lot of "if"s

I would have thought that this was what the interview was meant to determine.

oh...i am sad to hear that...but dont worry...let's just pray to GOD and and ask His guidance....its HIS will....dont lose hope....all this is just trials...just hold on....who knows??the passport with visa is in its way to your wife....pray........

I would imagine the reason the officer is so cautious with your case is because of your marriage by proxy. Although the marriage is valid in the eyes of CIC, the officer in Manila may have some doubts about the marriage.

Hopefully they realize the circumstances of your situation and are convinced that the marriage is genuine.

Thank you for all the support.

I know to some it may seem like a marriage of convenience given the proxy marriage. It's not something we would have done if we had a choice. Our lawyer did submit the application under Humanitarian & Compassionate grounds so perhaps they are reviewing that aspect of the application. My doctor provided a detailed letter as to why I would not be able to travel there. In addition, we’ve had two Members of Parliament advocate on our behalf.

We plan on getting married when my wife arrives in Canada so we can say our vows face-to-face. I'd love nothing more than to visit the Philippines to spend time with my wife, her family & friends, and enjoy the culture. I used to love traveling. But the last time I ignored my doctor’s advice regarding travel I ended up in hospital for 2 weeks shortly after arriving back in Canada. My inner ear (equilibrium) could not tell up from down for weeks and I had to go on beta-blockers to regulate my heart rate. It seemed like my entire body thought I was living on Mars or something :S

Not yet but our lawyer says she's not surprised. Due to the H&C application she said they will carefully review the 350+ pages of supporting documentation and that will take some time.

Our lawyer said that she didn't feel the proxy marriage itself would be an issue since the immigration code allows for it and there have been successful appeals for such marriages including even marriage by phone allowed.

She believes the review will be based more on the depth of our relationship given we have not been able to spend time together in-person.

The visa officer said it would be about a month and we're at a month now so we'll just have to wait and see. Hopefully the visa will arrive this week.

Yes, hopefully you will get the visa soon.

I haven't been with my wife since January and it's difficult being apart for so long. But in the end it will be worth the wait.
