Re: Inquiry on Period to File Fiance Visa

Quote:
Having said all of that...based on your statement above, your fiance met the requirements of the rule and filed the application within the two-year window. If the postmark on the envelope is stamped with a date of January 3, 2006 or earlier, you will have nothing to worry about regarding that particular requirement.
What if he failed to include the check for payment of the fee on the application package sent on December 23, 2005? Will the filing be counted on the second filing (with the check payment) or the first filing (without the check payment)?

The requirement stipulates that the application must be filed within two years of the meeting. If the application was indeed submitted in time, USCIS would have recorded the receipt date, fulfilling that requirement. However, this may be a "gray area" and subject to interpretation, in which case USCIS could judge either way. Does an application without payment constitute a valid filing of the application?? I've never seen this particular set of circumstances but, if USCIS sends you an NOA2, the discussion should be over. I highly doubt that would be an issue during the visa interview.

I think the bigger question is why in the world did he wait so long to file anyway??

"Name Check"

Good day!

I dont know, if any of you guys experience being put on "Name Check".

Last year I found out that theres a typographical error on my Birth Certificate (on my middle name). But it was settled after two months. And NSO released a validated/corrected Birth Certificate. The same Birth Certificate was submitted at the Embassy on my Interview date.

After a week I haven't heard from Delbros and me & my fiance decided to call the Embassy. The lady advised him that theyre doing some "Name Check" and it may take 4-6 weeks.

Does it have to do with my corrected Birth Certificate? If so, I dont think it will take them 4-6 weeks to check on it.

Please advise. Thank you. GOD Bless.
