k1 isnt possible anymore

i got married last jan 7, 2006. my husband petitioned me for k1 last nov 2005. last july 20 i had my interview but unfortunately the consul said we have to apply now for k3 visa. so what they did is got our marriage certificate and the other papers we passed when we apply and forwarded it to back to us visa center. i was wondering we haven't filed for I-130 yet, would that still be processing? how long does the processing have to take? would all my medical and expenses be gone to waste? do we have to send now our I-130 form and payment? anybody please help me? i feel so so so helpless. thank you in advance!

It blows my mind how people knowingly file a fiancee K1, I-129 and then after that decide to get married. What part of FIANCEEE visa did you not understand? If you are a fiancee then that implies you ARE NOT married when visa is issued. You know the part about the guy getting to try the relationship out for 90 days first, see if all works out okay.
Geez I hope and pray everything works out for you okay.

Yes, you will have to start all over from the very beginning with a new visa petition. All time and money spent on application fees and medical exam have been wasted. If you are fortunate, you may arrive in the U.S. sometime next year.

Why on earth did you ruin the K1 visa application by getting married?

As others said, you restart from the very beginning (so around 1 year wait) and lost all time and money spent on K1 process.
Really sad you didn't wait to finish your K1 process and marry in the US ajust after your arrival.

Wow!! I don't really have much to add that hasn't already been said.

Apparently your husband didn't understand the instructions very well. If I'm understanding you correctly, you voluntarily presented your wedding certificate to the consular officer during your interview?? My biggest concern is regarding the reason the consular officer cited for your denial. A citing of misrepresentation could be disastrous but, if you were advised by the consular officer to file for a K-3, you should be ok.

However, as everyone else has told you, you do need start the entire process over from the beginning. Your husband can still file the form I-129F for the K-3 visa and concurrently file the I-130 form. I strongly suggest he pay close attention to the details this time. Maybe you can refer him to this website so he can better understand the process?

Are you sure there wasn't something misinterpreted in your post!!
If Not!
I suggest you have hubby do as Jeffk said and get on this site.

The K3/ CR-1 is WAY WAY MORE COMPLICATED than the K1.

Have him get in touch with Rbacon as I don't think he will have a chance doing a K3/CR-1 from what he did with the K1

If he is going to do it himself I suggest a CR-1.

It is a longer process but less complicated than a K3 but at least he may have a chance.
Plus YOU check around here A LOT as it looks like your hubby will need help!
