Denied @Port of entry 4 yrs ago,grounds for visa denial now?

Hello. This is such an interesting and very helpful forum. I hope you guys could enlighten me with my dilemna. I am currently on I-130 and K3, along with our 3 year old son. I am just a little bit worried that my experience 4 years ago would still affect our petition. I was denied entry and sent home when I tried to visit my husband, I was at that time 6 months pregnant. I was so distraught and devastated. They said that I wasnt on petition ( which was true at that time) and I had to go back home "fix my papers". And so we did. would this awful experience,which am sure is recorded on their files, be grounds for k3 or I-130 denial? If anybody of you has had experience just like mine,or if you have any thoughts about it pls pls do share it with me.

I'm very glad you posted your story here because I feel it will be useful to others in your situation. Being denied at the POE is something many people seem to believe is simply a myth. Your story is proof that it does indeed occur.

I'm not sure I fully understand your situation, but I'll assume that the husband you went to visit four years ago is the same person who is petitioning you now. Perhaps he was your fiancé or even boyfriend at that time? Regardless of his relationship to you at the time of your POE denial, that event should have little, if any, impact on your current K-3 petition. You were denied entry because, in the opinion of the POE officer, you were a risk to overstay the terms of whatever visa you attempted to use to enter the US. Based on the facts that you were pregnant at the time and admitted that you were going to see your husband/fiancé/boyfriend, the POE officer felt you had little incentive to depart the US before your visa expired and would become an undocumented immigrant or "TNT".

You may be questioned about this during your interview at the embassy but the POE denial alone is not grounds for denial of your K/IR visa. Just relax and explain the details of the event as you have here and you should be fine.

Your next time through POE should be much better because your intent to immigrate to the US will be obvious from the K/IR visa you'll present.

Hello Jeff and ives! I am very thankful for your reply, sure am so much RELIEVED! hehehe. Yes, he was my husband at the time I was denied entry, we were married there before I went back here in the Phils, but he wasnt a citizen yet. He took oath just last year '05, so he decided to finally fix our papers this year. It was a very traumatic experience for me and my husband, but I guess things like that happen once ia a persons life right?? It took me a long time to get over that...

Again thank you thank you so much for your advice..now there is less stress and pressure for me. Will update you guys with what will happen next.....visa or no visa?.... thanx and God bless!

hello wifey,
how are you?hope you doing great.i think we have the same situation here.i got denied to enter the states too 2 years ago.that was 2004..that visit will be my 4th time.they suspecting me entering as an immigrant not a tourist.but never overstayed in all my visits.now im married to a us citizen just last month and im also kinda worried if my petition to him will be affected...i really dont know what going to happen...please let me know about your case if you have some news came up..i will really appreciate it..thanks a lot and god bless!
